In the travel ban cases, DOJ filed emergency stay applications and a petition for certiorari at the Supreme Court late last night. President Trump announced that the U.S. will withdraw from the Paris climate agreement, and a deluge of legal and political analyses followed. News also leaked that the administration is considering broad new exemptions to the requirement that employer-based health insurance provide contraception coverage. And former FBI Director Comey's congressional testimony has been set for next week, which has prompted discussion of whether the President could invoke executive privilege to prevent him from testifying.

The Rule of Law and the Resistance Police

6/1/17  //  Commentary

Trump’s defenders have long ascribed illegitimate motives to his critics. Now they’re doing that to the judges who have found Trump’s policies unlawful. That’s not okay.

Daily Update | June 1, 2017

6/1/17  //  Daily Update

White House sources say that President Trump is planning to withdraw the United States from the Paris Climate Accord. Attorney General Jeff Sessions’s proposed budget for the Department of Justice says nothing about prosecuting illegal use of force by police officers. Jared Kushner’s company used a federal loan program intended to subsidize low-income housing to build a luxury residential building. Congress is investigating whether Jeff Sessions, who falsely testified before the Senate that he “did not have communications with the Russians,” may have had an additional private meeting with Russian Ambassador Sergey Kislyak. And Jim Comey, former Director of the FBI, will testify before the Senate Intelligence Committee as early as next week.

The fallout continues over President Trump's firing of FBI Director James Comey. Trump contradicted his own staff, saying that he decided to fire Comey before meeting with Attorney General Jeff Sessions and Deputy AG Rod Rosenstein. Republican Representative Jason Chaffetz requested that the DOJ Investigator General investigate the firing. And Acting FBI Director Andrew McCabe testified before Congress, contradicting Administration claims regarding the importance of the Russian-interference investigation and Comey's support in the FBI. Meanwhile, Trump signed an executive order creating a Presidential commission on election integrity, to be lead by Kansas Secretary of State Kris Kobach.

Details continue to emerge about President Trump’s decision to fire FBI Director James Comey. Amidst the furor, President Trump met with the Russian Foreign Minister and the Russian Ambassador, excluding American journalists while granting access to Russian media. Reports surface that Comey had sought additional resources for the FBI’s Russia inquiry shortly before being fired. A journalist was arrested for questioning Secretary Tom Price about the American Health Care Act.

The House of Representatives passed the American Health Care Act (AHCA), a bill that Republicans characterize as an effort to repeal and replace the Affordable Care Act (ACA). The AHCA now faces significant hurdles in the Senate. In other news, the Senate passed a funding bill to avert a government shutdown but excluded many of Trump's more controversial policy proposals. And Trump signed an executive order entitled "Promoting Free Speech and Religious Liberty," which was narrower than expected (but still significant).
